Thevatheril & Kramer Obtain Defense Verdict in Medical Negligence Case
Swanson, Martin & Bell, LLP attorneys Aiju C. Thevatheril and Daniel P. Kramer secured a defense verdict on behalf of their client, a hospitalist, in the Circuit Court of Cook County, Illinois.
This wrongful death lawsuit involved the passing of a 46-year-old female patient who died three days after being discharged from a Chicago-area hospital following treatment for acute pancreatitis.
The plaintiff alleged that the patient’s death was the result of an improper discharge by the attending hospitalist, claiming that the patient was suffering from undiagnosed sepsis, which allegedly caused her death three days later.
Throughout the proceedings, the defense maintained that the care provided met the standard of care and that the patient was stable and appropriately discharged.
The plaintiff asked the jury for $4,000,000 in damages. After an 8-day trial, the jury returned a verdict of not guilty for the defendants. The case was tried before Judge Patricia O'Brien Sheahan.
