Thevatheril and Kramer Obtain Appellate Victory Upholding Summary Judgment for Psychiatrist in Kane County Medical Negligence Case
Swanson, Martin & Bell, LLP partners Aiju C. Thevatheril and Daniel P. Kramer represented a psychiatrist in a medical negligence case in Kane County Circuit Court. The plaintiff claimed that during an emergency room visit, the psychiatrist improperly discontinued the patient’s psychiatric medication, leading to a withdrawal seizure and a fall, which resulted in catastrophic injuries after the patient’s hospital discharge.
The firm successfully argued that the psychiatrist properly discontinued the medication and that the patient received appropriate medication management from the subsequent treating psychiatrist during their hospitalization. The Circuit Court granted summary judgment in favor of the firm’s client, concluding that the plaintiff’s psychiatry expert failed to demonstrate that the psychiatrist’s actions caused the patient’s injuries as a matter of law.
The plaintiff appealed the decision, but the Second District Appellate Court upheld the trial court’s ruling, affirming the summary judgment in favor of Swanson, Martin & Bell, LLP’s client.
