Law360 Quotes Weiler on Biggest Illinois Decisions of 2018Swanson, Martin & Bell, LLP partner Catherine Basque Weiler was quoted on Law360 this week regarding the biggest Illinois decisions announced of 2018.
Weiler named Peraino v. The County of Winnebago et al. as a noteworthy Illinois decision this year. According to the article, "The Second District Illinois Appellate Court in March ruled that a lawyer whose motion to reconsider was uploaded three minutes too late could not backdate his filing. The court held the plaintiff in a personal injury case missed the deadline and the trial court lost jurisdiction over the suit even though the e-filing system the lawyer used was allegedly encountering issues at the time."
Weiler said the ruling cements jurisdictional deadlines, but could lead to issues down the line, particularly with mandatory e-filing.
"You're going to have more of these come up, and I just don't know where the courts are going to be drawing the line on human error versus computer error versus some sort of general lack of knowledge of the rules," the article reads.
Weiler focuses on Appellate Practice. To read the full article, please visit Law360.
