Weiler Quoted in Law360 on Biggest Illinois Decisions of 2020

Partner Catherine Basque Weiler was quoted in Law360 this week regarding the biggest Illinois decisions of 2020. 

Weiler suggested Nichole Hamby et al. v. Bayer Corp. et al., a Supreme Court of the State of Illinois jurisdictional ruling which found the non-resident plaintiffs had identified "no jurisdictionally relevant links" between their claims over the device and Illinois, reversing circuit and intermediate appellate courts that had allowed the claims to go forward.

According to the article: 

They found that the U.S. Supreme Court's landmark Bristol-Myers Squibb v. Superior Court ruling foreclosed the non-residents' argument that Bayer's Essure-related activities in Illinois were enough to link their claims to plaintiffs Nichole Hamby's and Christy Rios' lawsuits.

The ruling's effects are mostly yet to be seen because the COVID-19 pandemic has significantly slowed the pace of litigation in the state, but it proves state courts will interpret specific personal jurisdiction the same way the Supreme Court does at the federal level, said Catherine Weiler, who chairs Swanson Martin & Bell LLP's appellate practice group.

That is helpful to litigants because "if there is consistency of application, it helps you focus on the substance of the case, which is a good thing," she said.
