Thevatheril and Kramer Secure Defense Verdict in Medical Malpractice Trial

Swanson, Martin & Bell, LLP attorneys Aiju C. Thevatheril and Daniel P. Kramer secured a defense verdict on behalf of their client, a maternal-fetal medicine physician, in a high-stakes medical malpractice trial in Cook County.

The plaintiff alleged that her obstetrical providers, including a maternal-fetal medicine physician, failed to provide proper counseling and recommendations regarding the management of placenta accreta spectrum. The plaintiff claimed that a delay in recommending treatment resulted in the loss of a second trimester pregnancy and an emergency hysterectomy.

The plaintiff sought $10 million in damages for medical bills, loss of a normal life, emotional distress, and post-traumatic stress disorder. The defense contended that the patient received appropriate counseling and recommendations from her obstetrical providers and that the injuries were caused by a rare, high-risk condition, which was properly diagnosed.

After a one-month trial before Judge Robert Harris, the jury deliberated for approximately one hour before returning a verdict in favor of the defense.
