Swanson, Martin & Bell, LLP Secures Defense Verdict in Medical Negligence Case

Swanson, Martin & Bell, LLP attorneys Aiju C. Thevatheril and Daniel P. Kramer secured a defense verdict at trial on behalf of their client, a cardiologist, in the Circuit Court of Cook County, Illinois.

The plaintiff alleged that the cardiologist delayed taking the patient to the cardiac catheterization lab after the patient experienced chest pain following surgery and failed to do so within the 90-minute timeframe outlined in various guidelines.

At trial, the defense established that the timeframe was not required by the standard of care, that the cardiologist acted reasonably and that his care did not cause the plaintiff’s alleged injuries.

 The plaintiff, who now claims permanent heart failure and the need for a pacemaker, asked the jury for $3,153,000 million in damages. The jury returned a verdict of not guilty for the defendant. The case was tried before Judge Maureen Hannon.
