Swanson, Martin & Bell, LLP Attorneys Secure Defense Verdict for Radiology Technician in Alleged Battery Case

Swanson, Martin & Bell, LLP attorneys Richard J. Keating and Mary H. Carlson obtained a defense verdict on behalf of their client, a radiology technician, after a one-week trial in the Circuit Court of Cook County, Illinois.

In this case, the plaintiff alleged that the defendant radiology technician touched her inappropriately upon completion of a lumbar spine X-ray, resulting in emotional distress. The radiology technician denied any inappropriate conduct, denied committing a battery, and maintained that he acted in accordance with standard medical protocol.

In response, the defense argued that the radiology technician acted appropriately and that the hospital’s training, supervision, and retention of its staff met the applicable standards of care.

The hospital, which was also named as a defendant on the negligent training, supervision, and retention claims, was represented by Liz Jaci and Jemma Cota of Hughes, Socol, Piers, Resnick & Dym, LTD.

The plaintiff asked the jury for $6 million. After hearing all the evidence, the jury returned a verdict of not guilty for all defendants. The case was tried before Judge Mary Kathleen McHugh.
