Reveille and Kettering Secure Defense Verdict in Medical Malpractice Trial

Swanson, Martin & Bell, LLP attorneys Kristine Reveille and Katherine Kettering secured a defense verdict on behalf of their client, a hospital, in a medical malpractice trial in DuPage County.

The plaintiff alleged that the hospital’s ICU nurses were negligent in connection with care provided during a hospitalization for respiratory failure due to COVID. The plaintiff claimed that the alleged negligence caused pain, suffering, and emotional anguish.

The case involved an extended ICU admission during the height of the COVID pandemic. The plaintiff alleged that nursing staff failed to properly turn and reposition him during his hospitalization, resulting in a severe sacral wound that required additional inpatient and outpatient care.

The defense established that the patient received appropriate nursing care and was turned and repositioned in accordance with the standard of care. The defense further contended that the wound developed as a result of the patient’s critical illness and was not caused by the nursing care provided.

After a week-long trial before Judge Robert Rohm, the jury returned a verdict in favor of the defense.
