Murray, Kincaid Victorious in Creditors' Rights Matter

Swanson, Martin & Bell, LLP attorneys Alfred K. Murray II and Joseph P. Kincaid were recently victorious in a Creditors’ Rights matter. A Cook County, Ill. Circuit Court judge ruled in favor of the firm’s creditor clients involving a complicated competition with a third party creditor to enforce judgments against common debtors. The issue decided by the Court addressed the priority of certain liens against the debtors’ membership interests in limited liability companies.

In his ruling, the judge repeatedly cited from the equitable remedies chapter of the Illinois Institute for Continuing Legal Education’s handbook, “Creditors’ Rights in Illinois,” written by partner Jeffrey S. Becker, as well as Kincaid and Murray. Becker, Kincaid, and Murray also wrote the 2014 supplement to the chapter.
