Law360 Interviews Drumke for "Cannabis Corner" Article

Swanson, Martin & Bell, LLP partner Michael W. Drumke was interviewed for Law360's "Cannabis Corner" series.

Drumke became the first chair of the American Bar Association’s Cannabis Law and Policy Committee this summer and co-chaired the ABA's first-ever nationwide program devoted to teaching attorneys about marijuana and hemp law, which, according to the article, is "another signal that the country’s largest organization of lawyers has gotten serious about the industry."

When asked about areas of ignorance or misapprehensions lawyers still have about cannabis, Drumke stated: 

I think attorneys looking at getting involved in the space have to understand that the industry is facing all kinds of issues: Insurance is a problem, for example. What’s available is expensive, and the coverage is not very comprehensive. Real estate is a problem because anyone with a federally backed mortgage may be concerned about leasing to a dispensary, for example. Intellectual property is a problem, because there are certain things the [U.S. Patent and Trademark Office] won’t give protection to. There are environmental issues arising that are not straightforward. The vaping problem is going to be a products liability issue. You can see the plaintiffs bar organizing already around it. And then there’s obviously the overlap between the [Federal Trade Commission] and [U.S. Food and Drug Administration] in terms of things like CBD.
