Fourth Circuit Affirms Summary Judgment for Firm Client
The United States Court of Appeals for the Fourth Circuit affirmed summary judgment for Swanson, Martin & Bell, LLP’s client in an asbestos defense matter.The plaintiff alleged that her husband developed mesothelioma from working as a pipefitter while assisting with the construction of a manufacturing plant in 1972 in North Carolina. Swanson, Martin & Bell, LLP obtained summary judgment after the U.S. District Court for the Middle District of North Carolina found there was no evidence of asbestos exposure at the facility and the client owed no duty to the plaintiff as the employee of an independent contractor. The plaintiff appealed the District Court’s decision and last week, the Court of Appeals ruled in the client’s favor and affirmed the District Court’s decision.
