Fardy, Reilly Represent Convenience Store Chain in IP Dispute
Swanson, Martin & Bell, LLP partner P. Stephen Fardy and of counsel Jonna McGinley Reilly are representing an Indiana-based convenience store chain in an intellectual property dispute.
The chain has filed a complaint in U.S. District Court asking that it be allowed to continue referring to its four-sided doughnuts as “square donuts,” even though another Indiana bakery has made its own version since the 1960s. The chain argues that the name is descriptive and generic, prohibiting it from being trademarked.
