Drumke Profiled in "Law Firm Leaders" Article for Chicago Daily Law Bulletin

Chicago Daily Law Bulletin profiled Swanson, Martin & Bell, LLP partner Michael W. Drumke in their recurring "Law Firm Leaders" series.

Drumke serves as chair of the American Bar Association's Tort Trial and Insurance Practice Section Cannabis Law and Policy Committee chair. Drumke spoke to the publication about negotiating legal minefields as cannabis becomes legalized in Illinois, but remains illegal federally. According to the article:

The ethical concerns for attorneys, particularly in Illinois, providing counsel to cannabis business owners was the focus of the ABA’s first-ever national cannabis-focused law conference last month, “From Regs to Riches: Navigating the Rapidly Emerging Fields of Cannabis & Hemp Law” in Chicago. Drumke was program co-chair.

During the two-day program, Drumke moderated an ethics panel titled “Ethics — Keeping Your License AND Your Cannabis Clients.”

The U.S. Constitution’s supremacy clause makes federal law as “supreme law of the land,” blocking cannabis business owners from access to different industries and to attorneys seeking to represent them, Drumke said.

“The majority of states have said its OK to be in the business of growing and distributing something that falls under Schedule I of the Controlled Substances Act,” Drumke said. “The implications of navigating the ethical considerations are interesting to say the least.”
