Appellate Court Affirms Dismissal of Professional Negligence Claim

This past October, the Second District Appellate District affirmed a Lake County, Illinois trial court dismissal of a professional negligence claim against a psychologist represented by Swanson, Martin & Bell, LLP.

The plaintiff claimed that the psychologist's report to the court in a divorce proceeding caused him to lose custody of his children. The trial court dismissed the complaint after partner William J. Rogers and associate Kevin M. Ringel argued judicial immunity for the court-appointed psychologist, lack of patient-psychologist relationship, and lack of proximate cause.

Rogers and partner Catherine Basque Weiler successsfully persuaded the appellate court to affirm the dismissal.
