Bell, Monaco Defeat Plaintiff’s Federal False Claims Act Complaint
Swanson, Martin & Bell, LLP attorneys Brian W. Bell, Anthony J. Monaco and Julie D. Miller won a motion to dismiss a federal False Claims Act complaint filed against a large manufacturer.
The lawsuit, brought in the Northern District of Illinois, alleged that the manufacturer violated the federal False Claims Act in relation to warranties provided to the government. Bell, Monaco, and Miller, on behalf of their client, filed a motion to dismiss the litigation, asserting the claims were not assumed by the manufacturer in its bankruptcy and that the complaint failed to properly state a claim. Judge Dow agreed with the manufacturer's motion and dismissed the case in a 22-page written opinion.
