McGovern, Maritime Law Professors Submit Amicus Brief to United States Supreme Court

Timothy S. McGovern, Of Counsel at Swanson, Martin & Bell, LLP, was one of 36 maritime law professors who submitted an amicus brief to the Supreme Court of the United States in the case of Lozman v. City of Riviera Beach. In the amicus brief, the maritime law professors urged the reversal of the 11th Circuit, which defined a “vessel” as any structure that floats.

The Supreme Court reversed the 11th Circuit on January 15th, and adopted a “reasonable observer” test to determine if a structure falls within the statutory meaning of a “vessel” under 1 U.S.C. § 3.

McGovern, chair of the firm’s Admiralty, Maritime and Transportation Practice Group, is an adjunct professor of Admiralty Law at The John Marshall Law School in Chicago.
