John D. Malarkey

Mr. Malarkey has more than 25 years of experience in representing public and private companies, partnerships and municipal entities on all phases of real estate litigation and transactions. During this time, he has focused on mortgage and tax foreclosures including litigation and workout strategies for lenders, developers and property owners. His litigation experience also includes lease and contract enforcement, eminent domain and zoning procedures. His transactional experience includes acquisitions, dispositions, construction, financing and leasing. Additionally he has lectured and moderated numerous panels on foreclosure and workout issues.
His most recent representative matters include:
- Served as counsel to a regional homebuilder with regard to foreclosure/workout strategies with entitlements and special service agreements issues
- Served as counsel to a not-for-profit entity with regard to zoning and development of a 200 bed Assisted Living facility
- Served as counsel to a developer with regard to a metropolitan development site, including zoning and TIF issues
- Served as counsel to a bank with regard to the negotiation, acquisition and leasing of real property taken through deeds in lieu of foreclosure
