Swanson, Martin & Bell, LLP enjoys a well deserved reputation as one of the elite litigation firms in America. The members of the firm’s Appellate Practice Group have made, and continue to make, several important contributions to the firm’s great success. First, the very knowledgeable appellate practitioners are available to provide advice and counsel to the firm’s highly skilled trial lawyers. The members of the Appellate Practice Group are indeed “lawyers’ lawyers.” They stand ready to assist trial counsel in developing and defining issues; in preparing case dispositive motions before trial; in preparing motions in limine to limit the presentation of an opponent’s evidence at trial; in preparing motions for directed findings and verdicts; and in preparing post-trial motions. The efforts of the Appellate Practice Group contribute to success in the trial court and to the creation of a record that is readily defensible in the courts of review.

The Appellate Practice Group is available to provide a client with effective appellate representation in state and federal courts of review throughout our country, including the United States Supreme Court in Washington, D.C., if necessary. This appellate representation is available to clients who were represented in trial courts by other firms as well as to those clients represented by our own skilled trial counsel. A case may first come to the firm when it is approaching trial, when it has been decided, or when it is already on appeal. At any point in the case, the Appellate Practice Group stands ready to assist.

The record compiled by the Appellate Practice Group is quite impressive. Focusing its expertise in written and oral argument nationwide, these extremely capable attorneys have written more than 200 appellate briefs, which have been presented throughout the United States and which have resulted more than 50 published opinions.

When scientists employed by universities, nonprofit institutes or corporations publish scientific studies, they routinely make their underlying research data available to peer reviewers and anyone else who is interested. A recent U.S. Court of Appeals for the District of Columbia Circuit decision, Pavement Coatings Technology Council v. United States Geological Survey, confirms that federal government scientists should be no different. They cannot shield their published work from professional, industry or public criticism by invoking Freedom of Information Act Exemption 5 — the deliberative process privilege — as a reason for refusing to disclose their exploratory research data.
