According to the article, "The Second District Illinois Appellate Court in March ruled that a lawyer whose motion to reconsider was uploaded three minutes too late could not backdate his filing. The court held the plaintiff in a personal injury case missed the deadline and the trial court lost jurisdiction over the suit even though the e-filing system the lawyer used was allegedly encountering issues at the time."
Weiler said the ruling cements jurisdictional deadlines, but could lead to issues down the line, particularly with mandatory e-filing.
"You're going to have more of these come up, and I just don't know where the courts are going to be drawing the line on human error versus computer error versus some sort of general lack of knowledge of the rules," the article reads.
