Becker, Albright Defeat Defamation Lawsuit

Swanson, Martin Bell, LLP successfully defeated a defamation lawsuit filed by Hungarian Olympic swimmer, Katinka Hosszu, against its clients, Casey Barrett and Swimming World Magazine. The U.S. Court of Appeals for the Ninth Circuit affirmed the dismissal of the lawsuit in late December. 

According to Law360, "two judges in a three-judge Ninth Circuit panel agreed with a lower court ruling that a series of articles in 2015 by former Olympic swimmer and journalist Casey Barrett, in which he questioned whether Hosszu’s success could have been achieved without the use of PEDs, did not support her defamation and false light claims. The majority concluded that the articles appearing on Barrett’s blog and in Swimming World Magazine, published by Sports Publications International Inc., were not meant to portray objective facts, 'but are instead interpretations of facts available to both the writer and the reader.'"
